Kansas did something remarkably simple last month: it told 1,700 people that their driver’s licenses needed to reflect biological reality. The state invalidated licenses and birth certificates that had been changed to display a gender marker that doesn’t match the holder’s biological sex. And if you listen to the media, you’d think the state just declared martial law.
Let’s back up. In 2023, Kansas changed its legal definition of sex to mean male or female as assigned at birth — joining fifteen other states that have done the same thing. The Kansas Supreme Court tried to override the Legislature and allow gender marker changes to continue anyway. So the Legislature did what legislatures do: it passed a new law making it crystal clear. Democratic Governor Laura Kelly vetoed it. The Republican supermajority overrode her veto. Democracy in action.
The Horror: Accurate Government Documents
The law requires that state-issued identification documents reflect biological sex. That’s it. That’s the whole controversy. People who previously changed their gender markers are being told to come get a new license with accurate information. The cost? $8.75 for an updated license. Twenty-six dollars for a new ID. We’re not exactly talking about an undue burden here.
But NBC News frames this as though Kansas rounded people up in the night. They quote residents saying they’re “heartbroken” and “moving to another state.” One person says they refuse to turn in their license. The ACLU filed a lawsuit. A district judge declined to block the law, noting there isn’t enough evidence that accurate IDs cause harassment. Because of course there isn’t — your driver’s license isn’t a billboard.
The Bathroom Provision
The law also includes a provision requiring people to use bathrooms matching their biological sex in government-owned buildings. House Speaker Daniel Hawkins said it plainly: this is about protecting women and girls. The penalties are $1,000 for individuals and up to $125,000 for government entities that rack up multiple violations. The fact that this even needs to be legislated tells you everything about where we are as a country.
The Real Story Nobody Wants to Tell
Attorney General Kris Kobach has been fighting this fight for years, and he’s right. Government documents exist to accurately identify people. A driver’s license is not a vehicle for self-expression — it’s a legal document that tells a police officer or a bank teller who you are. When those documents contain inaccurate biological information, they fail at their most basic purpose.
The ACLU attorney argued that requiring accurate IDs forces trans people to reveal their transgender status. But that’s the point of an ID — it identifies you. If your appearance doesn’t match the sex listed on your government-issued identification, that’s a personal matter, not a legislative failure.
One Republican — exactly one — voted against the bill, saying he couldn’t show how accurate gender markers caused “harm to the state.” But the question was never about harm to the state. It was about maintaining the integrity of official documents and protecting women’s spaces. Fifteen other states have reached the same conclusion. The federal government, under President Trump’s executive order, has too.
The people threatening to leave Kansas over this are free to do so. Last time anyone checked, there are buses, trains, and U-Hauls available in every state. Kansas will survive.
